RTI GYAN Article 8

Till know we went through about various terms involved in RTI act,what is first appeal,what is second appeal.Let us make quick rewind of the time frames for getting information and when we can file complaint.

What is the time limit to get information from PIO?

1.30 days from date of file of application.

2.48 hours for information concerning the life and liberty of the person

3.5 days shall be added to the above response time,in case the application is given to Assistant public information officer (APIO).

4.If the interests of the third party are involved then the time limit will be 40 days(maximum period+time given to the party to make representation)

5.Failure to provide information within the specified period is a deemed refusal.

If we do not get information within the time period mentioned above we should go for first appeal and then second appeal.You can even go for first appeal if you are not satisfied with the reply given by PIO or the PIO doesn’t respond to your application i.e. information is refused.

Def.: Third Party:Third party means a person other than the citizen making a request for information and includes a public authority.There is no exact or precise meaning for third party.It depends on case to case how third party is defined.

Object of the Right to Information Act :

Right to Information

The basic object of the Right to Information Act is to empower the citizens, promote transparency and accountability in the working of the Government, contain corruption, and make our democracy work for the people in real sense. An informed citizenry will be better equipped to keep necessary vigil on the instruments of government and make the government more accountable to the governed. The Act has created a practical regime through which the citizens of the country may have access to information under the control of public authorities.

As said,starting feb 12th we would be posting various details about RTI act for the betterment and easy understanding of the act here is the first article related to it.

Let us first now when RTI(Right to Information )act was formed ?

1. It was passed by Parliament on 15 June 2005 and came fully into force on 13 October 2005.Till then all information disclosure was restricted by various acts,one such act being official secrets act 1923.RTI act is credited as one of the best laws of the world.
2. RTI act is an Act to provide for setting out the practical regime of right to information for citizens to secure access to information under the control of public authorities(like Municipal corporation,government offices,hospitals,public sector companies etc.), in order to promote transparency and accountability in the working of every public authority, the constitution of a Central Information Commission and State Information Commissions and for matters connected therewith or incidental thereto.
3.It is one such act which empowered its citizens to an extent where he can exercise powers similar to a member of parliament in seeking information.

This is one of the best practices of democracy where people are not only restricted to selection of its representatives but also play a dynamic role in decision making,accountability of government which indirectly affects their day to day life in some or other form.Now,government is in our hands and its our minimum responsibility to make best use of this great act.
